Your privacy is important for Oté. We therefore process only the data that we need in order to provide/improve our services, and make careful use of the data that we have collected about you and your use of our services. We never make your information available to third parties for commercial purposes. This privacy policy applies to the use and the corresponding services of Oté. The start date for the validity of these conditions is 01 May 2018, and the publication of a new version cancels the validity of any previous version. This privacy policy describes which data about you we collect, what these data are used for and with whom, and under which conditions these data may possibly be shared with others. We also explain how your data is stored, how we protect your data against misuse, and what rights you have with respect to the personal information you have provided us. About the data processing

Below we explain how we process your data, where we store it or have it stored, which securing techniques we use, and who has access to these data.

Web hosting

We use the web hosting and email services of Rosegaar.nl. This party processes personal data on our behalf and does not use your data for its own purposes. However, this party can collect metadata about the use of the services. These are not personal data. Rosegaar.nl has taken suitable technical and organisational measures to prevent loss and unauthorised use of your personal data.

Purpose of the data processing

General purpose of the processing

We use your data only for purposes of our services. This means that the purpose of the processing is always directly related to the job you give us. We do not use your data for direct or indirect marketing. If you share data with us and we use these data – other than at your request – to contact you at a later point, we will ask for your explicit consent. Your data are not shared with third parties, other than in order to meet accounting and other administrative obligations. These third parties are all bound to confidentiality based on the agreement between them and us, an oath, or as legally required.

Automatically collected data

Data that is automatically collected by our website are processed with the purpose of improving our services. These data (such as your IP address, web browser and operating system) are not personal data.

Cooperation with fiscal and criminal investigations

If applicable, when legally obliged Oté may be required to share your data in connection with a fiscal or criminal investigation by the government. In such cases we are obligated to share your data, but we will oppose this within the possibilities allowed by the law.

Duration of storage

We keep your data for as long as you are our customer. This means that we keep your customer profile until you indicate that you no longer wish to make use of our services. If you communicate this to us, we will treat this as a removal request. Based on applicable administrative requirements we have to keep invoices with your general/personal data; we will keep these data for the duration of the applicable term. However, we will no longer have access to your customer profile or to documents that we acquired in the context of your project.

Your rights

Based on applicable Dutch and European legislation, as a party involved you have certain rights with respect to the personal data that are processed by us or on our behalf. Below we explain which rights these are and how you can invoke them. In principle, to prevent misuse, we send invoices and copies of your data only to the email address we already have on record for you. In the event that you wish to receive these data at a different email address or by mail, we will ask you for identification. We keep track of processed requests, and in the event of a request for removal we process anonymized data. You will receive all invoices and copies of data in the machine-readable data format that we use in our system. You have the right at all times to submit a complaint to the Data Protection Authority if you suspect that your personal data is being used the wrong way.

Right of access

You have the right at all times to access the data that we process or have processed and which relate to you or can be traced back to you. You can make a request to this end via our contact person for privacy matters. You will receive a reaction to your request within 30 days. If your request is approved, we will send a copy to the email address we have on record for you of all the data with an overview of the processers of these data, indicating the category under which we stored these data.

You have the right at all times to have modifications made to the data that we process or have processed and which relate to you or can be traced back to you. You can make a request to this end via our contact person for privacy matters. You will receive a reaction to your request within 30 days. If your request is approved, we will send a confirmation to the email address we have on record for you that the data have been modified.

Right to limited processing

You have the right at all times to restrict the data that we process or have processed and which relate to you or can be traced back to you. You can make a request to this end via our contact person for privacy matters. You will receive a reaction to your request within 30 days. If your request is approved, we will send a confirmation to the email address we have on record for you that the data will no longer be processed until you cancel this restriction.

Right to transmissibility

You have the right at all times to have another party make modifications to the data that we process or have processed and which relate to you or can be traced back to you. You can make a request to this end via our contact person for privacy matters. You will receive a reaction to your request within 30 days. If your request is approved, we will send to the email address we have on record for you invoices or copies of all the data about you that we have processed or which were processed on our behalf by other processers or third parties. In all probability, in such cases we would no longer be able to continue providing services, because safe linking of data files can no longer be guaranteed.

Right of objection and other rights

As applicable, you have the right to object to your personal data being processed by or on behalf of Oté. If you submit an objection, we will immediately suspend the data processing, awaiting the handling of your objection. If your objection is warranted, we will make invoices and copies of data that we processed or had processed available to you, then permanently suspend the processing. You also have the right not to be subjected to automated individual decision-making or profiling. We do not process your data in a way that this right would be applicable. However, if you consider that this is the case, you can contact our contact person for privacy matters.

Google Analytics

Cookies from the American company Google are placed via our website as part of the Analytics service. We use this service to keep track of and get reports of the way in which our visitors use the website. This processer may be legally required to give access to these data, as applicable. We have not authorised Google to use the obtained analytics data for other Google services.

Changes to the privacy policy
